A will sets out how assets are distributed at death and allows an individual to name guardians for minor children, appoint an executor, and provide instructions for settling an estate. A properly structured trust can help avoid probate, provide continuity in the event of incapacity, and offer greater flexibility over how and when assets pass to beneficiaries. Trust-based planning is often appropriate for individuals or families with real estate, minor children, blended families, business interests, or more complex asset structures.

Probate is the legal process used to settle an estate after someone has passed away. It involves gathering and transferring assets, addressing outstanding obligations, and carrying out the terms of a will or, where there is no will, applying Texas law.
